Security is a condition when vital interests of the individual, the society and the state are being protected from domestic and foreign threats (art. 1 of the Federal Law “On security”). At the same time, the rights and the freedoms of the individual, as well as the constitutional order, the sovereignty and the territorial integrity of the state along with material and spiritual values are protected and safeguarded by legal instruments, including those belonging to criminal law. In its turn, the exercise of rights must be limited by law for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society (art. 29 of the Universal Declaration of Human Rights). In today’s special circumstances the world is experiencing totally new safety threats which involve restrictions of the rights of others through various means and instruments, but not by law. Agreements which regulate cooperation between states in the security realm are being dissolved and replaced by sanctions pressure, armed rebellions, mutinies and violation of the rights of national minorities, which are becoming the norm. In this context, the rejection of legal rules for the sake of choosing between something bad and something terrible takes on increasing importance in the society. The Plenary Session proposes to discuss admissibility and possibility of departure from the principle of legal security and justice in favour of political willpower, relevance and necessity of criminal defense of social and military security of the state with help of new instruments, as well as admissibility of personal rights restriction in favour of the rights of others, which means a departure from the Universal Declaration of Human Rights
